Terms and Conditions

1. GENERAL TERMS

1.1. The owner of the online store Herbaniq.eu (hereinafter referred to as "the Store") is "International Trading Service SIA" with registration code "43603077821" , located at Udens street 12, Riga, Latvia, LV-1007.

1.2. Customers must read and agree to these Terms before placing any orders. By ticking the "I agree" checkbox or completing a purchase, the Customer confirms their acceptance of these Terms.

1.3. The Seller reserves the right to modify or update the Terms at any time without prior notice. Changes take effect once published on the Store's website. Orders placed before the updates will be processed according to the Terms valid at the time of purchase.

1.4. If the Customer violates these Terms, the Seller reserves the right to restrict, suspend, or terminate their access to the Store.

1.5. The Seller is not liable for damages or losses incurred due to the Customer’s failure to comply with these Terms.

2. CUSTOMER REGISTRATION DIRECT MARKETING AND PROCESSING OF PERSONAL DATA

2.1. Customers may register an account at Herbaniq.eu by providing accurate personal information such as name, email address, phone number, and shipping address.

2.2. By registering, the Customer agrees to the processing of their personal data for order fulfillment, delivery, and communication purposes in accordance with the General Data Protection Regulation (GDPR) and the Latvian Personal Data Processing Law.

2.3. The Seller ensures that personal data is handled securely and used solely for the purposes stated in these Terms.

2.4. The Customer is responsible for maintaining the confidentiality of their login details. In case of unauthorized access, the Customer must notify the Seller immediately to prevent further unauthorized use.

2.5. The Seller will not share personal data with third parties except for partners involved in delivery or payment processing. Personal data may only be disclosed to legal authorities if required by law.

2.6. The online store only uses the personal data entered by the purchaser for processing the order and sending goods to the purchaser. The online store forwards personal data to the transport service provider in order to deliver the goods.
The online store sends newsletters and offers to the purchaser’s e-mail address only if the purchaser has expressed their wish to receive them by entering their e-mail address on the website and indicating their desire to receive direct mail.

The purchaser is able to opt-out of offers and newsletters sent to their e-mail address at any time by letting us know via e-mail or by following the instructions in an e-mail containing an offer.

3. PRODUCT INFORMATION

3.1. The Store provides detailed descriptions of each product, including ingredients, usage instructions, and any applicable warnings.

3.2. While the Seller strives to ensure the accuracy of product images and descriptions, minor variations (e.g., color, packaging design) may occur due to differences in manufacturing or display settings.

3.3. Food supplements offered in the Store are not intended to diagnose, treat, cure, or prevent any disease and should not replace a balanced diet or professional medical advice.

3.4. All information available on Herbaniq.eu is machine-generated translation and not guaranteed to be accurate.

4. PURCHASE AGREEMENT

4.1. A purchase agreement is formed when the Seller confirms the Customer's order. Order confirmation will be sent to the email address provided by the Customer.

4.2. The Customer is obligated to pay the full price of the ordered products, including applicable taxes and delivery fees, as specified during checkout.

4.3. The agreement is fulfilled once the ordered products have been paid for and delivered to the Customer.

4.4. Each new order constitutes a separate purchase agreement between the Seller and the Customer.

4.5. Add the desired products to your shopping basket to order them. Fill in all of the required fields and choose the most suitable shipping method to complete the order. The total cost is then displayed on the screen. This can be paid securely via the payment methods provided by Maksekeskus AS

5. PRICES AND PAYMENT

5.1. All prices are in € (EURO) and are displayed in the Store including VAT (Value Added Tax) at the rate applicable in Latvia.

5.2. Delivery fees, if applicable, will be clearly stated during the ordering process before the Customer confirms their purchase. The shipping cost depends on the location of the purchaser and the shipping method.

5.3. Payments can be made via secure online payment system provided by Maksekeskus AS,

  • Estonian bank payments: Swedbank, SEB, Luminor, LHV, Coop Pank, Pocopay, Citadele

  • Latvian bank payments: Swedbank, SEB, Citadele and Luminor

  • Lithuanian bank payments: Swedbank, SEB and Luminor, Šiaulių Bankas

credit/debit cards, or other methods available on the Store. Payment processing is handled through third-party providers to ensure security.

5.4. The Seller is not responsible for payment errors caused by incorrect information entered by the Customer or issues with the payment provider.

 

6. DELIVERY POLICY

6.1. The Seller offers delivery within the European Union with estimated shipping times provided during the checkout process.

6.2. Shipping fees depend on the total order value:

For Latvia, Estonia, Lithuania:

  • Orders below €50: Delivery fee of €4.99.

  • Orders above €50: Free delivery.

For rest of European union:

  • Orders below €75: Delivery fee of €12,99

  • Orders above €75: Free delivery.

6.3. The Customer must provide a valid and complete shipping address. The Seller is not responsible for delays or losses due to incorrect or incomplete addresses.

6.4. Orders are processed on business days and shipped within 1-3 working days. Delays caused by external factors (e.g., customs, weather) are beyond the Seller’s control.

6.5. All Shipments to Latvia, Estonia, Lithuania usually arrives within 4 working days (excluding Holiday periods)

Shipment to rest of the European Union is within 1-3 weeks, but in some cases may take up to 45 days.

 

7. RETURNS AND REFUNDS

7.1. Customers (except legal person) have the right to return unused and unopened products within 14 days of receipt in accordance with EU consumer protection laws.

7.2. To initiate a return, Customers must contact the Seller at [info@herbaniq.eu]. Returned items must be in their original packaging and accompanied by proof of purchase.

7.3. The Seller will process refunds within 14 days of receiving the returned items, provided they meet the return criteria. Refunds will be issued using the original payment method.

7.4. The Seller covers return shipping costs only if the product is defective or incorrect. For returns due to personal preference, the Customer bears the return shipping costs.

 

8. WARRANTIES AND LIABILITY

8.1. The Seller guarantees that products meet the quality standards and specifications outlined in their descriptions.

8.2. The Seller is not liable for:

  • Improper use or storage of products by the Customer.

  • Allergic reactions or adverse effects due to individual sensitivities. Customers are advised to read product labels carefully and consult a healthcare professional before use of any product purchased at Herbaniq.eu.

8.3. The Seller's liability is limited to the value of the purchased products. Under no circumstances is the Seller liable for indirect or consequential damages.

 

9. CUSTOMER RESPONSIBILITIES

9.1. The Customer agrees to:

  • Provide accurate information when placing an order.

  • Use products according to the instructions provided.

  • Refrain from sharing their account details with third parties.

9.2. The Customer is responsible for ensuring they are legally permitted to purchase and use the products in their country of residence.

 

10. INTELLECTUAL PROPERTY

10.1. All content on Herbaniq.eu, including product descriptions, images, and branding, is protected by intellectual property laws.

10.2. Copying, distributing, or reproducing content without prior written consent from the Seller is strictly prohibited.

 

11. GOVERNING LAW AND DISPUTES

11.1. These Terms are governed by the laws of the Republic of Latvia.

11.2. In case of disputes, both parties agree to attempt resolution through negotiation. If no resolution is reached, disputes will be settled in the courts of Latvia.

11.3. All complaints made by a purchaser about the online store must be e-mailed to or submitted by calling.
If the purchaser and the online store are not able to settle the dispute by agreement, the purchaser may contact the Consumer Dispute Committee. The Consumer Dispute Committee is competent to resolve disputes arising from a contract between a purchaser and the online store. The resolution of disputes by the Consumer Dispute Committee is free of charge for the purchaser.

A purchaser may also turn to the dispute resolution bodies of the European Union.
